Terms of Use for MemoryPalace

Please read these Terms of Use ("Terms") carefully before using the MemoryPalace dApp ("the dApp"). By downloading, accessing, or using the dApp, you agree to be bound by these Terms. If you do not agree, do not use the dApp.

1. Acceptance of Terms

By accessing or using the dApp, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into this agreement. These Terms are a binding agreement between you and Lipi ("Publisher"), based in Bangladesh.

2. Jurisdiction

These Terms are governed by and construed in accordance with the laws of Bangladesh. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bangladesh, unless mandatory law in your country of residence requires otherwise.

3. Description of Service

MemoryPalace is a decentralized application ("dApp") built for the Solana Mobile ecosystem. Turn boring to-do lists into absurd, unforgettable stories. The dApp interacts with the Solana blockchain through your own Solana wallet; the Publisher does not hold or control your funds or private keys.

4. Blockchain Risks

You acknowledge and agree that:

  • Blockchain technology and crypto-assets are subject to high volatility, market risk, and regulatory uncertainty.
  • Transactions on the Solana network are irreversible once confirmed.
  • The Publisher is not responsible for any loss resulting from network failures, wallet software issues, lost or compromised private keys, or user error.
  • Nothing in the dApp constitutes financial, investment, or legal advice.

    • 5. User Conduct and Content

    You agree not to use the dApp to create, store, or share any content that is illegal, violent, hateful, sexually explicit, harassing, or infringing on the rights of others. The dApp does not support public user-generated content; any content you create is stored locally on your device and is not published to the blockchain or shared with other users.

    6. Prohibited Activities

    You may not:

  • Use the dApp for any illegal purpose or in violation of applicable law.
  • Attempt to reverse engineer, decompile, or exploit vulnerabilities in the dApp.
  • Use the dApp to distribute malware, spam, or deceptive content.
  • Misrepresent your affiliation with any person, brand, or organization.
  • Interfere with the operation of the dApp or the Solana network.

    • 7. Support and Refunds

  • Support: The Publisher is solely responsible for providing customer support for the dApp. Contact us at mistlipi@proton.me.
  • Refunds: As the "Seller of Record," the Publisher is responsible for all purchase-related queries and refunds. Solana Mobile is not responsible for issuing refunds for the dApp.

    • 8. Limitation of Liability

    To the maximum extent permitted by law, the Publisher shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the dApp; (b) any unauthorized access to or alteration of your transmissions or data; or (c) any other matter relating to the dApp. Solana Mobile and its affiliates are not parties to these Terms and bear no liability with respect to the dApp.

    9. Termination

    The Publisher may suspend or terminate your access to the dApp at any time, with or without cause. You may stop using the dApp at any time. Sections that by their nature should survive termination (including blockchain risk, limitation of liability, and jurisdiction) shall survive.

    10. Changes to These Terms

    The Publisher may update these Terms from time to time. Updated Terms will be effective when posted in the dApp or on the Publisher's website. Continued use of the dApp after changes constitutes acceptance of the revised Terms.
